1. Waiver and Release: I, the parent of a basketball participant, release and forever discharge and hold harmless the Overtown Optimist Club and the City of Miami and its successors and assigns from any and all liability, claims, and demands of whatever kind of nature, either in law or in equity, which arise or may hereafter arise from the services I provide to Nonprofit. I understand and acknowledge that this Release discharges Nonprofit from any liability or claim that I may have against Nonprofit with respect to bodily injury, personal injury, illness, death, or property damage that may result from the services I provide to Nonprofit or occurring while engaging in physical activity.
2. Insurance: Further I understand that Nonprofit does not assume any responsibility for or obligation to provide me with financial or other assistance, including but not limited to medical, health, or disability benefits or insurance. I expressly waive any such claim for compensation or liability on the part of Nonprofit beyond what may be offered freely by Nonprofit in the event of injury or medical expenses incurred by me.
3. Medical Acknowledgement and Release: I hereby Release and forever discharge Nonprofit from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during this field trip with the Nonprofit. I acknowledge the health risks associated with the Activity, including but not limited to transient dizziness, lightheaded, fainting, nausea, muscle cramping, musculoskeletal injury, joint pains, sprains and strains, heart attack, stroke, or sudden death. I agree that if I experience any of these or any other symptoms during the Activity, I will discontinue my participation immediately and seek appropriate medical attention. I do hereby release and forever discharge the released parties from any claim whatsoever which arises or may hereafter arise on account of any first aid treatment or services rendered in connection with my participation in the Activity.
All parents and guardians of players recognize that participation, involvement and/or attendance at any flag football event or Activity is voluntary and may result in personal injury (including death) and/or property damage.
COVID-19 SAFETY:
4. While participating in events held or sponsored by the Nonprofit, social distancing must always be practiced and face coverings worn to reduce the risks of exposure to COVID-19. Because COVID-19 is extremely contagious and is spread mainly from person-to-person contact, Nonprofit has put in place preventative measures to reduce the spread of COVID-19. However, Nonprofit cannot guarantee that its participants, volunteers, partners, or others in attendance will not become infected with COVID-19.
5. In light of the spread of COVID-19, individuals who fall within any of the categories below should not engage in Nonprofit events and/or other face to face fundraising activities. By attending a Nonprofit event, you certify that you do not fall into any of the following categories:
